TindakMalaysia Network Services Pty Ltd (or also known as “Tindak”, “us”, “we”) is committed to protecting your privacy. This section of the form (or website or contractual agreement with us) sets out our privacy policy. Tindak Malaysia Network Services Pty Ltd is a registered company in Malaysia with a strong advocacy focus on electoral reforms and carrying out electoral research work pertaining to Malaysia. This privacy policy stipulates the collection, processing and storage of personal data when you communicate (written or verbal) with us, the website, or fill out our data request forms or contractual agreement with us. This is to comply with the laws of Malaysia. By engaging with us via email or our data request forms, or signing an agreement, you will be provided with a link/PDF/written statement to/of our Privacy Policy. You need to provide consent to TindakMalaysia Network Services Pty Ltd to receive our services and products.
In our data request forms, there will be a box where your consent must be marked. In our email communications (such as those regarding signing a contractual agreement), you will be provided with a privacy notice as a link to our website or an appropriate form. For consent for communication to be opened with a third party, a written request will be communicated in writing (via email) to seek consent will be issued.

– Obtaining your personal information through third parties with whom we have an agreement, where you have consented to the third parties and/or wherever the law permits

When you browse our website (https://www.tindakmalaysia.org/), which you do so anonymously, our cookies may collect information related to name of Internet Service Provider, Internet Protocol, the date and time when you access our webpage, the link of any webpage from which you accessed our site and the web browser that you are using and currently accessing to. We are not bound by the privacy policy of third-party websites (including the privacy policy of Google-based forms) through which you came to know us.
We have collected and will collect your data (as per attribute and collected through singular or multiple means) to be processed by us and/or on your behalf in the course of your present or future dealings with us to enable us to achieve the purposes listed below:
1) To perform due diligence on your background as a requester of information products and services
2) To administer and manage an ongoing relationship between you and Tindak Malaysia Network Services Pty Ltd (both verbal and written)
3)To utilise information for quotation, invoices and receipts (including collection of unpaid
invoices)
4) To arrange or confirm your participation in any events conducted by Tindak Malaysia Network Services Pty Ltd
5) To share your data with a third party (i.e. email address and name) if necessary for the preparation of
the agreement to be entered by you. You will be informed beforehand before the disclosure to a third party occurs
6) To comply with all legal and regulatory requirements and for disclosure as per legal and/or governmental authority
7) To discharge services and products as per contractual obligations (Whereby your name and signature will be
requested)
8) For our internal records and internal research purposes
9) To communicate any changes to our Privacy Policy
For the disclosure of information to third parties as stipulated in (5) in the list above, not only will you be informed beforehand, but a different consent will be obtained to allow communications with third parties to occur. You are advised to seek any privacy notice from the third party before receiving any products or services.
Failure to provide mandatory, accurate and current information about your data to us will hinder TindakMalaysia Network Services Pty Ltd from providing products and services as you requested. For example, in order to perform due diligence of your background as a requester of data, personal information collected via the data request form will include your name, your organisation, public profile link, email and other relevant contact details. Failing to provide one or more personal information to TindakMalaysia Network Services Pty Ltd will not allow us to provide the data requested to you. Failure to provide accurate information (which is your obligation as a requester) will also hinder us from informing you of any corrections or improvements to the products and services.
Personal information will only be disclosed to:
– Legal or government authority due to legal and regulatory requirements and/or due to legal notices, orders from courts and queries from local authorities
– Among TindakMalaysia’s Core Leadership, Database Lead and authorized members of Tindak Malaysia Network Services Pty Ltd
– Auditors, consultants, legal advisers, lawyers, or any appointed professional advisor on a confidential and fiduciary basis who provides us with their services
– Information shared to third parties will be bound by the terms and conditions within the request for information from the data subject and requires the data subject’s consent.
– Storage management, data centres and record keeping services
– Providers of email management services and distribution tools
The purposes of such disclosures are to comply with the Malaysian laws, respond to legal matters, and to protect our requesters and our organisation’s name, products and services.
Tindak Malaysia shall act by the Personal Data Protection Act 2010 (PDPA) in any commercial transaction carried out involving your data.
However, Tindak Malaysia is not responsible for data collected by entities that may process your information, for example, IP addresses, except that we will, to the best of our knowledge, provide a notice of such occurrence.
We will not transfer your data outside of Malaysia except to countries of similar PDPA laws are being applied, with your written consent from your end, for legal proceedings and the conclusion and performance of contractual obligations between you and TindakMalaysia. We are committed to upholding confidentiality, security and protection of your data. We will endeavour to ensure that personal data is accorded with right protection and ensure Tindak members (“data processor”) do their part to uphold confidentiality.
Your data provided to us in any form will be retained for the purpose it was collected. Once the purpose is deemed complete, we will take reasonable steps to destroy your data. For legal, accounting, past communication receipts and taxation purposes, we will retain your data about quotations, invoices and receipts. Retention of the personal data is subject to existing laws of the time.

1) To be informed – you have been made aware and understand our Privacy Policy
2) To access your personal information – upon your request to access your information, you will be given a form to seek access to the information, and we will respond to the request within 21 days of the receipt of the request. Should we be unable to comply with your request, we will inform you in writing of our inability to fulfil the request with the reasons within 21 days of the ascension of the request. We will comply with the request to the extent we are able to do so. Refusal to accept requests is based on the following grounds:
(a) Inability to identify your details based on the data access request form, failure to satisfy the relation between you and the data subject
(b) The burden or expense of providing access is disproportionate to the risks to the data subject’s (i.e. you) privacy about the personal data in the case in question
(c) disclosing personal data relating to another individual who can be identified from that information, unless the individual has consented information to be disclosed to you
(d) that constitute a violation of an order of a court
(e) providing access would disclose confidential commercial information
3) To rectify/correct – If you believe that any of your personal information provided to TindakMalaysia Network Services Pty Ltd is inaccurate, you have the right and obligation to inform us as soon as possible, and we will provide the necessary form within 21 days of the receipt of the request. Should we be unable to comply with your request, we will inform you in writing of our inability to fulfil the request with the reasons within 21 days of the ascension of the request. We will comply with the request to the extent we are able to do so. Refusal to accept requests is based on the following grounds:
(a) Inability to identify your details based on the data access request form
(b) The expression of opinion is considered by the requester to be inaccurate, incomplete, misleading or not up to date;
4) For erasure, you are to send in writing, should removal of personal data be requested. However, please be informed that this will hamper the discharge of our services and obligations to you.
5) To restrict processing – you are to send in writing, should you want us to cease processing or the processing of specified purpose or in a specified manner. The basis of restricted processing is when the processing of your data causes substantial damage or distress to you, and the damage or distress to you is unwarranted. Restrictions will be assessed according to legal applications, contractual obligations and will be done within a reasonable period. We will inform you in writing within 21 days from the date of receipt of the request, stating whether we have complied (or intend to comply) with the request or stating the reasons of refusal should the request be deemed unjustifiable.
The exemptions to this section are:
(a) You provided consent for the continued processing of your data during the performance of the agreement (the agreement of Tindak Malaysia data privacy policy)
(b) processing of personal data is necessary to the performance of the agreement, for the taking of steps at the request of the data subject to enter into a contract
(c) for compliance with any legal obligation in Malaysia, ONLY to which the data user is the subject, other than an obligation imposed by contract
(d) to protect the vital interests of the data subject (you as the requester)
6) For data portability – you have the right to request a copy of your data, and grant us written consent to transfer your data from us to an appointed third party that you mention
7) To object to direct marketing – you have the right at any time by notice in writing to us, require the data user (TindakMalaysia Network Services Pty Ltd) at the end of such period as is reasonable in the circumstances to cease or not to begin processing your data for purposes of direct marketing
From time to time, we reserve the right to amend the Privacy Policy and communicate the updated Privacy Policy either on the website or by a written notification directly to you.
I have read this Privacy Notice and understand the reasons for the collection and processing of my data. I have been informed about my rights and obligations in this Privacy Notice. I am aware that I can access and correct my data on request and if necessary. However, I understand that, in exceptional circumstances, access can be denied, and I will be informed of the reasons for denial and remedial actions that will be available in the form or method as mentioned in this Privacy Policy. TindakMalaysia akan bertindak selaras dengan Akta Perlindungan Data Peribadi 2010 (PDPA) dalam semua urusan komersial. Namun, TindakMalaysia tidak bertanggungjawab atas data yang dikumpul oleh pihak lain (contohnya alamat IP) kecuali kami akan memaklumkan anda mengenainya.
Kami tidak akan memindahkan data anda ke luar Malaysia kecuali ke negara yang mempunyai undang-undang PDPA yang serupa, dan hanya dengan persetujuan bertulis anda, serta untuk prosiding undang-undang dan pelaksanaan kontrak antara anda dan TindakMalaysia.
Maklumat anda akan disimpan selama diperlukan untuk tujuan asal. Setelah tujuan dicapai, data akan dimusnahkan secara wajar. Untuk tujuan undang-undang, percukaian, akaun dan rekod komunikasi lampau, data seperti invois dan sebut harga mungkin disimpan mengikut undang-undang yang berkuat kuasa.
